Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the SeniorHomesGuide.com website, mobile interfaces, and related services (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

Important, please read carefully: these Terms include a binding individual arbitration provision and class action waiver (Section 16) that affect your legal rights, a limitation of liability (Section 13), and required state-specific notices (Section 22).

1. About the Platform

SeniorHomesGuide.com is an educational platform that provides information about assisted living facilities and nursing homes in Florida, primarily using publicly available state records (including data from the Florida Agency for Health Care Administration, “AHCA”). We are not a healthcare provider, senior care facility, medical professional, attorney, financial advisor, or placement agent. We may facilitate introductions between consumers and facilities or care advisors and may receive compensation from those partners as described in Section 7.

2. Definitions

  • “Site” means the SeniorHomesGuide.com website and any related online services we operate.
  • “You” or “your” means the natural person accessing the Site or, if the Site is accessed on behalf of an entity, that entity.
  • “We,” “us,” or “our” means Good Vibes Marketing, LLC d/b/a Senior Homes Guide Florida and its owners, employees, and affiliates.
  • “Care Partner” means a senior living community, nursing home, care advisor, or other third-party operator listed on or connected through the Site.
  • “User Content” means any text, data, files, ratings, comments, or other content you submit to or through the Site.
  • “Sponsored Placement” means a Care Partner in the directory or facility listing presented in a paid-promotion position; such placements are clearly labeled wherever they appear.

3. Eligibility

By using the Site, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are not barred from using the Site under any applicable law. If you are using the Site on behalf of another adult (for example, a parent or relative), you represent that you have the legal authority to do so. The Site is not directed to children under 18, and we do not knowingly collect personal information from them.

4. Use at Your Own Risk; Your Responsibility to Verify

The Site is an informational tool only. You use the Site at your own risk. Before you choose or move into any facility, including any facility listed or referenced on the Site, you agree that:

  • You will tour in person and use your own judgment; scores, rankings, and listings on the Site do not replace an on-site visit or direct questions to staff.
  • You will independently verify licensing, inspections, complaints, and current conditions using Florida's official sources, including Florida Health Finder (FloridaHealthFinder.gov), maintained by AHCA, and other AHCA public records, in addition to anything you see on the Site.
  • We do not tell you which facility is right or “best” for any person. We may present facilities that match criteria you select or sort public data to help you compare; you and your qualified professionals decide what is appropriate.

5. No Medical, Legal, or Professional Advice

All content on the Site, including facility data, educational articles, regulatory scores, AI- or algorithm-generated recommendations, and any other information, is provided for informational and educational purposes only. Nothing on the Site constitutes:

  • Medical advice, diagnosis, or treatment
  • Legal advice or counsel
  • Financial, insurance, or tax advice
  • A recommendation, endorsement, or guarantee of any specific facility or care provider
  • A guarantee of the quality, safety, suitability, availability, or admission terms of any facility

Always consult qualified healthcare professionals, attorneys, and financial advisors before making decisions about senior care.

If you interact with any care advisor, counselor, or specialist through or introduced by the Site, that person is not acting as your fiduciary, licensed medical provider, attorney, or financial advisor. They may help you organize your research and identify facilities that match your stated criteria, but their input does not substitute for consultation with your own qualified professionals.

6. Facility Data and Accuracy

6.1 Data Sources and Accuracy

Facility information displayed on the Site is sourced from publicly available records maintained by AHCA and other public sources. While we strive for accuracy, we make no guarantees that the data is current, complete, or error-free.

  • Inspection findings reflect conditions at the time of the inspection, not necessarily current conditions.
  • Regulatory scores and other derived calculations are estimates and should be considered alongside, not in place of, direct verification.
  • License status, capacity, pricing, and other details may change without notice on the Site.

Facility profiles may also include information provided by the facilities themselves, such as amenity lists, pricing ranges, photos, and descriptions. We do not independently verify this facility-provided content. Listing a facility on the Site does not constitute our endorsement, recommendation, or approval of that facility, its ownership, staff, or care quality.

You are responsible for verifying all information directly with the facility and relevant state agencies before making care decisions.

6.2 Fair Report Privilege

Facility information published on the Site is drawn from official government records maintained by AHCA and other public agencies. The publication of accurate reports of official government records is protected under Florida's fair report privilege. We republish that data as received from the government source; we do not originate, alter, or editorialize inspection findings, complaint records, or regulatory scores sourced from those records.

6.3 Scores and Rankings Are Opinion

Any score, ranking, match result, or comparative rating generated by the Site is an editorial opinion and estimate derived from publicly available data. These outputs represent our subjective methodology and weighting, not objective facts about any facility. Opinion is not actionable as defamation.

6.4 Facility Data Correction Requests

If you are a facility operator and believe that data published about your facility is factually inaccurate, you must submit a written correction request to info@seniorhomesguide.com with the subject line “Data Correction Request” before initiating any legal action. Your request must identify the specific data you believe is inaccurate and provide documentation from an authoritative source (such as a current AHCA license or inspection report) supporting the correction. We will review and respond within 15 business days. Failure to submit a correction request and allow us a reasonable opportunity to respond is a condition precedent to any legal claim arising from data published on the Site.

6.5 Section 230 of the Communications Decency Act

To the extent facility profiles include content provided by the facility itself or by third parties (such as amenity descriptions, photos, or self-reported pricing), we publish that content as provided. We are not the author of such content for purposes of 47 U.S.C. § 230, and we claim the protections afforded by that statute accordingly. When a facility contacts us to update or correct information it originally provided, any update we make is based on the facility's own representations; we do not independently verify or vouch for that content, and making such an update does not make us the originator of the underlying facts or representations.

6.6 Facility Disputes Subject to Arbitration

Any claim by a facility operator or Care Partner arising out of or relating to data, scores, rankings, or other content published about that facility on the Site is subject to the binding arbitration and class action waiver in Section 16, to the same extent as claims by individual users.

7. Lead Sharing, Care Partner Connections, and How We Make Money

How we are compensated. SeniorHomesGuide.com is a free service to consumers. We are compensated by Care Partners, senior living communities, assisted living facilities, and care advisors, through one or more commercial arrangements, which may include success-based placement fees (calculated as a percentage of the first month's rent or another agreed amount when a resident moves in), flat listing fees, per-lead fees, or other commercial arrangements. This fee is paid by the Care Partner, not by you. Compensation does not affect facility data, regulatory scores, or the ranking of organic search results. Facilities paying for placement are clearly labeled as Sponsored placements wherever they appear.

Connecting you with Care Partners. When you request to be connected with a facility or care advisor through the Site, you authorize us to share your submitted inquiry information (name, contact details, care preferences, and other details you provide) with the relevant facility or vetted Care Partner. This process:

  • Requires your explicit, informed consent at the time of submission;
  • Is disclosed clearly before any information is shared;
  • May result in the facility or partner contacting you by phone, email, text, or other means; and
  • Can request we stop further contact at any time by emailing info@seniorhomesguide.com. Note: information already shared at the time of submission cannot be recalled.

How sharing works and your right to opt out. When you submit a connection or match request, we share your inquiry with the Care Partner we connect you to. If that partner is a senior care advisor, we are paid a referral fee for the lead, which the Florida Digital Bill of Rights treats as a “sale” of personal information; if it is a senior living facility, the facility may pay us a placement fee only if you take a tour or move in. Because the sharing happens at the moment you submit, you control it through the consent shown on that form: if you do not submit a connection or match request, your information is not shared, and you can still browse the Site and view recommendations without providing contact information. See our Privacy Policy §11 for full details. The Medicaid and skilled-nursing carve-outs in Sections 7.1 and 7.2 below always apply.

Phone and text consent. By providing your phone number and requesting a connection, you provide prior express written consent as described in our Privacy Policy §8 to receive calls and texts from us and from the Care Partners you select, which may include calls or texts sent using automated dialing equipment or prerecorded messages. Consent is not required to use the Site or to access facility information.

Care Partner independence. Care Partners are independent businesses. We are not responsible for their representations, staffing, care quality, regulatory compliance, or outcomes. We encourage you to independently evaluate any Care Partner before making a decision.

7.1 Medicaid and Federal Healthcare Program Carve-Out

Consistent with Florida Statute §429.195(2)(b) and §817.505 (patient brokering), and the federal Anti-Kickback Statute, we do not collect, pay, solicit, or receive any fee, commission, kickback, bonus, or other consideration in connection with a referral or placement when the resident's care is funded in whole or in part by Medicaid, Medicare, or any other federal or state healthcare program. Our agreements with care advisors and other Care Partners contractually prohibit them from doing so as well. When a user indicates Medicaid as a funding source through our questionnaire, or when the directory's Medicaid filter is active, the system automatically suppresses Sponsored Placements and presents only organic, ranked matches derived from AHCA or other public data.

In-product disclosure shown to users (verbatim): “Per Florida §429.195(2)(b) and §817.505, no referral fee is collected for Medicaid placements. The matches are ranked equally based on amenities offered and public data including AHCA, and no sponsored or paid-placement results are shown. Verify Medicaid LTC Waiver eligibility through Florida ACCESS / DCF.”

7.2 Nursing Homes (Skilled Nursing Facilities)

Florida Statute §400.176 and the federal Anti-Kickback Statute prohibit any commission, bonus, or kickback for residents referred to a nursing home or skilled nursing facility (SNF). The Site does list nursing homes alongside assisted living facilities for informational and research purposes, but we do not accept, collect, solicit, pay, or receive any fee, commission, Sponsored Placement, or other consideration in connection with a nursing-home referral or placement under any circumstances, regardless of payment source. Our agreements with care advisors and other Care Partners contractually prohibit them from doing so as well. Sponsored Placements are automatically suppressed in any nursing-home search context. We encourage independent verification of all nursing-home information through Florida Health Finder (AHCA) before any decision.

In-product disclosure shown to users (verbatim): “Per Florida §400.176 and the federal Anti-Kickback Statute, no fee, commission, or sponsored placement is collected for any nursing-home connection regardless of payment source. The matches are ranked equally based on amenities offered and public data including AHCA, and no sponsored or paid-placement results are shown.”

8. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose, or in any way that violates these Terms or any applicable law;
  • Attempt to scrape, crawl, harvest, or systematically extract data from the Site beyond normal interactive use;
  • Submit false, misleading, or fraudulent information, including impersonating another person or facility;
  • Reverse engineer, decompile, or attempt to derive the source code of any software underlying the Site;
  • Interfere with or disrupt the Site's operation, security, or performance, including by uploading viruses or malicious code;
  • Use the Site to transmit unsolicited communications, advertising, or spam;
  • Frame, mirror, or otherwise reproduce the Site without our prior written consent; or
  • Use any data obtained from the Site for any purpose competitive with us, including building or training a competing directory or model.

9. User Content

You retain ownership of any User Content you submit. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, create derivative works from, communicate, publish, publicly display, and distribute that User Content for the purposes of operating, providing, improving, and promoting the Site, and to comply with applicable law. You represent and warrant that you have the rights necessary to grant this license and that your User Content does not infringe or violate any third-party rights.

You are solely responsible for your User Content. We may, but are not obligated to, review, moderate, or remove User Content at any time and for any reason.

10. Intellectual Property

The Site's design, branding, original content, educational articles, software, and the selection and arrangement of data are owned by Good Vibes Marketing, LLC d/b/a Senior Homes Guide Florida and protected by applicable intellectual property laws. Facility data sourced from public records remains in the public domain; our compilation, scoring, presentation, and curation of that data are protected.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial research purposes. All other uses require our prior written consent.

11. Third-Party Links and Services

The Site may contain links to third-party websites and services, including state agency sites, facility websites, and Care Partner pages. Those third parties are not controlled by us and have their own terms and privacy practices. Your use of any third-party site or service is at your own risk and subject to that third party's terms.

12. Termination and Suspension

We may suspend or terminate your access to the Site at any time, with or without cause and with or without notice, including for any violation of these Terms, suspected fraud, or any conduct we determine, in our sole discretion, to be harmful to other users, the Site, our partners, or third parties. You may stop using the Site at any time. Sections 5, 6, 7, 9 (license to us), 10, 13, 14, 15, 16, 17, and 20 survive termination.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOOD VIBES MARKETING, LLC D/B/A SENIOR HOMES GUIDE FLORIDA AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to use the Site;
  • Any conduct or content of any third party, including facilities, Care Partners, or other users;
  • Any information obtained from the Site, including facility data, regulatory scores, or AI- or algorithm-generated recommendations;
  • Any decisions made or actions taken based on information provided on or through the Site.

IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). This limit applies regardless of the form of action (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages, and even if any limited remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY FACILITY DATA, SCORE, OR RECOMMENDATION IS ACCURATE OR COMPLETE.

15. Indemnification

You agree to defend, indemnify, and hold harmless Good Vibes Marketing, LLC d/b/a Senior Homes Guide Florida and its owners, operators, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Site; (b) your violation of these Terms or any applicable law; (c) your User Content; or (d) your interaction with any Care Partner or third party introduced through the Site.

16. Dispute Resolution; Binding Arbitration; Class Action and Jury Waiver

Please read this section carefully. It limits the way you can pursue legal claims against us.

16.1 Informal Resolution

Before initiating any formal proceeding, you agree to first contact us at info@seniorhomesguide.com with a written description of the dispute and the subject line "Legal Dispute", and to attempt in good faith to resolve it informally for at least 30 days.

16.2 Binding Individual Arbitration

Except for the exclusions in Section 16.4, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the relationship between you and us (a “Dispute”) will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, then in effect. The arbitration will be conducted by a single neutral arbitrator. The seat and venue of arbitration will be Broward County, Florida, unless you and we agree otherwise. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

16.3 Class Action and Jury Waiver

YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. Disputes must be brought on an individual basis only. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class proceeding. If this class-waiver provision is found unenforceable as to any claim, that claim must be severed and litigated in court, while the remaining claims proceed in arbitration.

16.4 Exclusions

Either party may bring an individual claim in small-claims court if it qualifies. Either party may also seek injunctive or equitable relief in court for actual or threatened infringement, misappropriation, or violation of intellectual property rights or these Terms.

16.5 30-Day Right to Opt Out

You may opt out of this arbitration agreement by sending written notice to info@seniorhomesguide.com within 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and including your full name and the email or address you used on the Site. Opting out will not affect any other portion of these Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Subject to Section 16, any judicial proceeding (for example, to compel arbitration or seek injunctive relief) must be brought exclusively in the state or federal courts located in Broward County, Florida, and you and we consent to the personal jurisdiction of those courts.

18. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, network or utility failures, or pandemics.

19. Notices

Legal notices to us must be sent to info@seniorhomesguide.com with the subject line "Legal Notice" and are effective when received. We may give you notice by email to the address you provided, by posting a notice on the Site, or by any other method permitted by law; such notices are effective when sent or posted.

20. General

  • Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior or contemporaneous understandings.
  • Severability. If any provision is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
  • No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • No Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
  • No Agency. Nothing in these Terms creates a partnership, joint venture, employment, agency, or fiduciary relationship between you and us.
  • Headings. Section headings are for convenience only and do not affect interpretation.

21. Modifications to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top, post a notice on the Site, and where reasonably practicable email registered users. Continued use of the Site after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Site.

22. Florida-Specific Notices

This Site covers senior care facilities located exclusively in the State of Florida. All facility information should be independently verified through Florida's official sources before any care decision.

  • AHCA, Florida Health Finder: Verify licensing, inspection reports, complaints, and current regulatory status at FloridaHealthFinder.gov, maintained by the Florida Agency for Health Care Administration (AHCA).
  • AHCA Consumer Hotline: For questions about facility licensing or complaints, contact AHCA at (888) 419-3456.
