SeniorHomesGuide.com is operated by Good Vibes Marketing, LLC d/b/a Senior Homes Guide Florida. In this Policy, “we,” “us,” and “our” refer to Good Vibes Marketing, LLC d/b/a Senior Homes Guide Florida. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit the Site or use our services. It also describes your privacy rights and how to exercise them.
This Policy applies to personal information we collect from consumers researching or inquiring about senior care. Use of the Site is also subject to our Terms of Service.
1. Notice at Collection
We collect the following categories of personal information from consumers:
- Identifiers, name, email, phone number, ZIP code, IP address, online identifiers.
- Internet or other electronic activity, browsing/search activity, device and browser information, interaction with the Site.
- Geolocation data, approximate location at the city/region level. If you use “Browse near me,” your browser may ask for permission to share device location. We use the latitude and longitude returned by your browser only to identify a nearby Florida city and county for directory filtering. We do not display, sell, or share your precise coordinates.
- Inferences, preferences and care criteria derived from your answers and activity.
- Sensitive personal information, health-related details you voluntarily share through the questionnaire (for example, memory or mobility concerns, mental-health diagnoses, skilled-nursing needs). See Section 5 for limits on use.
We collect this information to:
- operate and improve the Site;
- help you research senior care options;
- when you ask, connect you with senior care facilities or care advisors;
- communicate with you about your inquiry;
- prevent fraud and secure the Site; and
- comply with legal obligations.
We share your inquiry information with a Care Partner when you submit a connection or match request. If that partner is a senior care advisor, we are paid a referral fee and Florida law treats this as a “sale” of personal information; if it is a senior living facility, the facility may pay us only if you take a tour or move in. You decide whether this happens at the point you submit entered information, before anything is shared (see Section 11).
We retain personal information only as long as necessary for the purposes described in this Policy or as required by law (see Section 9).
2. Information We Collect
2.1 Information you provide directly
- Contact Information: name, email, phone, ZIP/city.
- Care Preferences: care type, budget range, timeline, financial-resource indicators (Medicaid, VA benefits, long-term care insurance, etc.), location preferences, and amenity preferences.
- Health-Related Answers: memory concern, mobility concern, mental-health, nursing needs, skilled-nursing needs, and similar answers used to compute facility recommendations. See Section 5.
- Communication Content: messages, feedback, and content you provide through contact forms or chat.
- Privacy Request Information: the contact information, request details, and identity-verification information you submit when exercising your privacy rights.
2.2 Information collected automatically
- Usage Data: pages viewed, time on page, search queries, facilities viewed, links clicked, navigation patterns.
- Device Information: browser type, operating system, device type, screen resolution, language preferences.
- Network Information: IP address, approximate geographic location (city/region), referring URL.
- Browser Location: when you choose “Browse near me” and grant browser permission, we temporarily process your device location to prefill city and county filters.
- Cookies and Similar Technologies: see Section 7.
2.3 Information from third parties
We may receive limited information from analytics providers (Google Analytics and Microsoft Clarity), advertising platforms, and Care Partners that confirm receipt of your inquiry. We do not buy supplemental consumer profiles from data brokers.
3. Sources of Personal Information
- Directly from you (forms, questionnaire, contact, chat).
- Automatically from your device and browser (cookies, log files, beacons).
- From service providers acting on our behalf (analytics, hosting, anti-fraud).
- From Care Partners that confirm your connection or inquiry status.
4. Categories of Recipients
We may share personal information with the following categories of recipients:
- Care Partners, senior living communities, nursing homes, and care advisors, when you submit a connection or match request and we share your inquiry with the partner we connect you to. Sharing your inquiry with a senior care advisor for a referral fee is treated as a “sale” under Florida law; sharing with a senior living facility (which may pay us only if you tour or move in) is part of connecting you. You control whether any sharing happens at the point you submit entered information (see Section 11). Compensation arrangements with Care Partners are subject to the Medicaid and SNF carve-outs described in our Terms §7.1 and §7.2.
- Service providers, hosting (Cloudflare), analytics (Google Analytics and Microsoft Clarity), email/SMS delivery, anti-bot protection (Cloudflare Turnstile), under contracts that limit their use to providing services to us.
- Advertising partners, including Meta and Google Ads, as described in Section 7. We do not use care or health-related questionnaire answers for advertising or behavioral profiling.
- Legal recipients, government agencies, regulators, courts, or law enforcement when required by law, subpoena, or to protect rights and safety.
- Successors, in connection with a merger, acquisition, financing, or sale of assets, with notice to you where required.
5. Sensitive Personal Information
Some of the information you provide through our care questionnaire, including answers about memory concerns, mental-health diagnoses, mobility, nursing needs, and skilled-nursing needs , constitutes sensitive personal information. We apply heightened care to this category of data and treat it with the highest degree of confidentiality.
We use sensitive personal information only for the purposes you provided it, primarily to compute relevant facility matches and, when you explicitly ask, to share it with the specific Care Partner you select. We do not use sensitive personal information for advertising, behavioral profiling, profiling for legally significant decisions, or any purpose beyond what is reasonably necessary to fulfill your request.
You may request that we limit or delete the sensitive personal information we hold by using the request channels in Section 11.
6. How We Use Personal Information
- Provide Services: operate the Site, deliver search results and recommendations.
- Fulfill Requests: process your inquiry, including the Help Me Pick, Book a Tour, and Get a Quote flows.
- Share with Care Partners: with your consent, share your inquiry details with the specific facility or advisor you select.
- Communicate: respond to your messages, send service-related notices, and (with consent) educational content.
- Improve the Site: analyze usage to improve content and features.
- Security and fraud prevention: detect and prevent abuse, including via Cloudflare Turnstile.
- Legal Compliance: comply with applicable laws and respond to legal process.
7. Cookies, Tracking, and Interest-Based Advertising
We use essential technologies for Site functionality, security, fraud prevention, and account sessions. We also use Google Analytics, Microsoft Clarity session replay, Meta Pixel, and Google Ads technologies to measure Site use and advertising performance. For visitors we identify as in the United States, other than Washington, these nonessential technologies may operate by default unless you opt out. For visitors we identify as in Washington, visitors outside the United States, and visitors whose location cannot be determined, we request affirmative consent before loading nonessential technologies.
We honor a supported Global Privacy Control (GPC) signal as an opt-out of nonessential analytics and advertising technologies for that browser or device. You may also use Privacy Choices at any time to allow tracking or opt out on the current browser or device. A browser or device choice does not automatically apply to another browser or device.
We configure public inquiry, quote, tour, contact, matching, survey, and advisor forms to mask entered form values from Microsoft Clarity. We do not intentionally send form inputs, email addresses, phone numbers, care needs, health-related selections, or lead payloads to our analytics vendors. We also do not use Meta Pixel or Google Ads events on care-needs, questionnaire, matching, lead, or contact flows.
You may submit a Do Not Sell or Share Request to ask us not to use the email address you provide in future advertising audiences, marketing lists, or server-side advertising events. This request records your preference for future use. It does not delete data previously collected by third parties, recall an inquiry already sent to a Care Partner, or stop essential technologies.
Industry opt-outs for interest-based advertising:
- Digital Advertising Alliance (DAA) YourAdChoices and Network Advertising Initiative (NAI) opt-out tool.
- Mobile devices: enable “Limit Ad Tracking” (iOS) or “Opt out of Ads Personalization” (Android) in device settings.
- Google Analytics: install the Google Analytics opt-out browser add-on.
8. Phone and Text Message Communications
8.1 SMS / Text Messages
If you provide your phone number and consent to receive text messages, we and the Care Partners you select may send text messages related to your inquiry. The following terms apply:
- Consent. Your consent is not a condition of using the Site or receiving information; you may decline and continue browsing.
- Frequency. Message frequency varies based on your inquiries and Care Partner responses.
- Carrier rates. Message and data rates may apply.
- Opt out. Reply STOP to any message to opt out. After opting out you will receive a confirmation message and no further messages from that program.
- Help. Reply HELP for help, or contact us at info@seniorhomesguide.com with the subject line "Privacy Request".
- Auto-dialer notice. Some messages may be sent using automated technology, including automated dialing equipment and prerecorded messages, as permitted by the Telephone Consumer Protection Act (TCPA).
8.2 Call Recording, Florida Notice
Florida law (Florida Statute §934.03) requires the consent of all parties to a telephone conversation before it may be recorded. If we or a Care Partner ever record a call with you, you will be notified at the start of the call and the recording will proceed only if you consent. We do not currently record inbound or outbound phone calls; if we introduce call recording in the future, this Policy will be updated and the required all-party consent will be obtained at the time of each call.
8.3 Email Communications (CAN-SPAM)
If we send you commercial email (such as updates about our services or educational content you requested), we comply with the CAN-SPAM Act (15 U.S.C. §7701). Each commercial email will identify itself as a promotional message and include an option to opt out of future commercial emails. You may opt out by clicking the unsubscribe link in any such email or by emailing info@seniorhomesguide.com with the subject line "Privacy Request". We will honor opt-out requests within 10 business days. Transactional emails related to your inquiry (such as submission confirmations and Care Partner connections) are not subject to this opt-out.
9. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, in line with the following guidelines:
- Inquiry data shared with a Care Partner: typically retained for up to 24 months from your last interaction.
- IP addresses and user-agent strings collected alongside form submissions: retained as long as reasonably necessary for fraud prevention, abuse detection, and legal compliance, and deleted or anonymized when no longer needed for those purposes.
- Consent and privacy-choice records (including browser or device preferences): retained for the length of legal limitations periods, typically up to 4 years.
- Privacy request records (including Do Not Sell or Share, access, deletion, and correction requests): retained for at least 24 months as required by law.
- De-identified analytics data: retained indefinitely; de-identified data is no longer associated with you.
Once your inquiry is shared with a Care Partner, that partner is a separate controller of your data and applies its own retention policy.
10. Data Security
We implement reasonable administrative, technical, and physical safeguards, including TLS encryption in transit, access controls, and bot/abuse mitigation via Cloudflare Turnstile, to help protect your information. However, no internet transmission or storage is 100% secure, and we cannot guarantee absolute security.
10.1 Breach Notification
If we experience a breach of security affecting your personal information, we will notify affected Florida residents without unreasonable delay and no later than 30 days after we reasonably determine a breach has occurred, as required by the Florida Information Protection Act (Fla. Stat. §501.171). We will notify you by email to the address we have on file, or by mail if email is unavailable.
11. Your Privacy Rights
We believe you should have meaningful control over your personal information. Regardless of any legal threshold, we offer the following rights to all users of the Site:
- Right to Know / Access: request the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for using it, and the categories of third parties we have shared it with.
- Right to Delete: request that we delete your personal information, subject to legal obligations (for example, consent records we are required to retain).
- Right to Correct: request correction of inaccurate personal information we hold about you.
- Right to Data Portability: request a copy of the personal information you provided to us in a portable, readily usable format, where technically feasible.
- Right to Limit Sensitive Information Use: request that we stop using your health-related questionnaire answers beyond the purpose for which you provided them, see Section 5.
- Right to Opt Out of the Sale of Personal Information: choose, at the point you submit a connection or match request, whether your inquiry is shared with Care Partners, and tell us at any time not to share your information in future inquiries. See the note below for how this works in practice.
- Right to Opt Out of Targeted Advertising and Profiling: direct us to stop processing your personal information for targeted advertising or for profiling in furtherance of decisions that produce legal or similarly significant effects. You can use Privacy Choices, submit a Do Not Sell or Share Request, use a supported GPC signal, or contact us as described below.
- Right to Non-Discrimination: we will not deny services, charge different prices, or provide a different level of service because you exercise your privacy rights.
A note on “sale” of personal information. Florida law defines a “sale” broadly as disclosing personal data to a third party for monetary or other valuable consideration. How we are compensated, and whether the sharing is a “sale,” depends on who we connect you with:
- Senior care advisors. When your inquiry is shared with a senior care advisor, whether you are matched to one or one is selected for you, we are paid a fee for that referral. Because we receive payment in exchange for disclosing your information, Florida law treats this as a “sale” of personal information.
- Senior living facilities. When your inquiry is shared with a senior living facility, we share it so the facility can respond to you, and the facility may pay us a placement fee only if you take a tour or move in.
How you control the sharing. You control this sharing at the point of submission, before anything is shared. Browsing the Site and viewing your recommendations does not require your contact information and does not result in any sharing or sale. Your inquiry is shared with a Care Partner only when you submit a connection or match request and provide the consent shown on that form, and it is shared at the moment you submit it. That means:
- If you do not want your information shared or sold, do not submit a connection or match request. You can still research facilities, view recommendations, and contact a specific facility or advisor yourself.
- Because your inquiry is shared the moment you submit it, we cannot recall an inquiry that has already been sent. The Care Partner then holds your information as an independent controller you may contact directly (Section 9).
- You may tell us at any time not to share your information in any future inquiry, using the channels in Section 11.1, and we will honor that going forward.
We never sell sensitive personal information (Section 5) or the personal information of anyone we know to be under 18.
Florida Digital Bill of Rights (FDBR). Florida's Digital Bill of Rights (effective July 1, 2024) grants additional privacy rights to Florida residents, subject to applicability thresholds set by Florida Statute §501.702. We are committed to honoring the rights listed above regardless of whether FDBR thresholds apply to us. Florida residents may also contact the Florida Department of Agriculture and Consumer Services with privacy-related complaints.
Federal rights. You may also have rights under federal law, including COPPA (children's data, Section 12) and TCPA (communications, Section 8).
11.1 How to submit a request
- Browser or device tracking choice: use Privacy Choices. This change takes effect for future activity on the current browser or device.
- Do Not Sell or Share Request: use the Do Not Sell or Share Request form to record a request concerning future use of the email address you provide for advertising audiences, marketing lists, and server-side advertising events.
- Email: info@seniorhomesguide.com with the subject line "Privacy Request".
We do not require identity verification to honor a browser or device tracking choice. For other requests, we acknowledge requests within 10 business days and respond within 45 calendar days (extendable by up to an additional 45 days where reasonably necessary, with notice to you).
11.2 Identity verification and authorized agents
Identity verification. Before fulfilling a request, we will take reasonable steps to verify your identity by matching information you provide (such as the email or phone associated with your inquiry) against our records. For sensitive requests we may ask for additional verification.
Authorized agents. You may designate an authorized agent to make a request on your behalf. We will require:
- written, signed authorization from you to the agent;
- verification of the agent's identity; and
- confirmation directly from you that you authorized the request.
A holder of a durable power of attorney under Florida Statute §709 satisfies these requirements.
11.3 Right to appeal
If we decline your request in whole or in part, we will tell you why. You may appeal by replying to our decision within 30 days or by emailing info@seniorhomesguide.com with the subject line “Privacy Appeal.” We will respond within 60 days. If you are dissatisfied with the outcome, you may contact the Florida Department of Agriculture and Consumer Services or the Florida Attorney General's office.
11.4 Washington consumer health data
This section applies to consumer health data subject to Washington's My Health My Data Act. It supplements the rest of this Policy for Washington consumers and data collected in Washington. Consumer health data may include health-related questionnaire answers and information that could identify a consumer's interest in, or use of, senior care services.
We collect consumer health data directly from you when you provide it in a questionnaire, request, or form. We use it to provide the senior care research, matching, and connection services you ask for. We share it with a specific Care Partner only when you submit the applicable request and consent presented with that request. We do not sell consumer health data, and we do not use it for advertising or behavioral profiling.
For Washington visitors, we request affirmative consent before loading nonessential analytics or advertising technologies. Washington consumers may withdraw that choice through Privacy Choices and may submit privacy requests using the methods in Section 11.1. We do not obtain valid consent for consumer health data through a generic Terms of Service or through continued browsing.
11.5 Nevada privacy notice
Nevada residents may submit a request to opt out of a sale of covered information by using the Do Not Sell or Share Request form or by emailing info@seniorhomesguide.com with the subject line "Nevada Opt-Out Request."
12. Children's Privacy
12.1 Children under 13 (COPPA)
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information, please contact us at info@seniorhomesguide.com with the subject line "Privacy Request" and we will promptly delete it.
12.2 Teens 13-17
The Site is intended for adults (18 and over) researching senior care. We do not knowingly collect personal information from individuals aged 13-17. If you believe someone under 18 has submitted information through the Site, please contact us and we will promptly delete it.
13. De-identified Data
We may de-identify or aggregate personal information so that it can no longer reasonably be used to identify you. We commit to maintain de-identified information without attempting to re-identify it, and to contractually require any recipients to do the same.
14. Third-Party Links
The Site may contain links to third-party websites, including state agency sites and facility websites. We are not responsible for the privacy practices of those sites. Please review their privacy policies separately.
15. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page with a revised “Last Updated” date and version number. For material changes, we will provide additional notice on the Site. Changes to this Policy do not replace any consent required by applicable law or change a privacy choice you have already made.
